1 Purpose
The site accessible by the following url: https://www.manufacturedemonaco.com is operated in accordance with Monegasque and European legislation.
The use of this site is governed by the present general conditions. By using the site, you acknowledge that you have read and accepted these conditions. The Editor cannot be held responsible in any way for any misuse of the service.
2 – Legal capacity
Customers declare that they are of legal age and fully capable of contracting.
3- Description and presentation of products
M de M does its utmost to ensure that the descriptions and visuals represent the products offered for sale as accurately as possible. However, M de M cannot guarantee that the descriptions and visuals are perfectly similar to the product sold, particularly with regard to colors.
The visuals and descriptions of the products cannot in any way engage the responsibility of M de M and give the right to any claim from the customer.
4 – Prices
M de M reserves the right to modify its prices at any time.
Any change in the rate of value added tax (VAT) will be immediately reflected in the price of the products sold.
5 – Availability of products
M de M always strives to satisfy its customers’ orders.
However, in the event that all or part of the products are unavailable and/or not in stock, the customer will be informed by M de M as soon as possible of the possibility of replacing the product or cancelling the order.
In the event of cancellation, the customer will be reimbursed for the amount debited from his bank account within a maximum of 14 days.
You are informed of the delivery time when you place your order. Longer delivery times are particularly important for orders for tableware and all orders for customized items.
We remind you that our porcelain pieces are entirely handmade, which may cause a delay in delivery at certain times of the year.
6- Delivery charges and taxes
Monaco
For all orders, a fixed contribution of ten (10) euros is requested from the customer to cover transport costs.
Other countries as defined in delivery zones
Prior to the final validation of the order, the customer has access to the total amount of his order, which includes the relevant taxes and delivery costs.
For all orders sent outside the European Union, customs charges may be applied in the country of destination. These customs fees are to be paid by the recipient upon arrival of the package. Following BREXIT, for all orders sent to the UK, please note that VAT is collected by the carrier when the parcel arrives in the UK.
7- promotional offers
Manufacture de Monaco Boutique offers its customers promotional offers in the form of Promotional Codes to be used on subsequent purchases and enabling the payment of all or part of an order on the Website. The value, the period of validity, as well as the methods of obtaining and using the Promotional Codes are specified on each offer.
The Promotional Codes can be used for any purchase made after obtaining the Code, according to their period of validity on all the products on the Website, except for the exceptions indicated in each offer, and in particular the preparation and delivery costs.
They may not be combined in the same order.
If a customer were to fraudulently use a Promotional Code, in contravention of the conditions set out in these GTC, the orders concerned would then be automatically cancelled by Manufacture de Monaco Boutique without this being able to be the subject of any dispute.
When using a Promotional Code, Manufacture de Monaco Boutique reserves the right to ask the Customer for his or her details and those of his or her bank card, for verification and security reasons.
8- Refusal of an order or cancellation of a purchase
M de M reserves the right to refuse an order or to cancel a purchase for just cause, in accordance with article L. 121-11 of the Consumer Code.
Refusal of an order or cancellation of a purchase for just cause does not give rise to any compensation but to a refund of the price of the products.
The refusal of an order or cancellation of a purchase may be for the following reasons
– Unavailability of the products
– Impossibility to execute the order and/or delivery (incomplete contact details or delivery address)
– Order likely to be intended for resale
– Incorrect sales price
– Fraudulent use of bank details
9- Delivery
9.1 Delivery area
The products are delivered to the address given by the customer when placing the order, provided that it is included in the delivery countries covered by these GTC: France, Germany, Luxembourg, Netherlands, Austria, Spain, Ireland, Italy, Portugal, Denmark, Estonia, Hungary, Latvia, Lithuania, Poland, Czech Republic, Slovakia, Slovenia, Sweden, Switzerland and the United Kingdom.
For any delivery in a country other than those mentioned above, the customer is invited to contact the Customer Service by email at e-shop@manufacturedemonaco.com
9.2 Delivery methods
Deliveries are made by designated carriers depending on the country of delivery.
The customer is informed by email of the date of shipment as well as the tracking number of his order.
The customer can at any time follow the progress of his parcel via a hypertext link to the carrier’s website.
In the event that the customer orders several products at the same time, M de M reserves the right to split the shipments. The customer will only be invoiced for the processing and shipping costs for a single shipment.
If the customer is not present at the time of delivery, a notice will be sent to inform him/her of the methods of storage and availability of the package.
In the event of an incomplete or erroneous delivery address, the customer will be responsible for the costs of resending the parcel.
The customer assumes full responsibility for the products from the moment of receipt.
9.3 Delivery problems
The customer will be informed by e-mail of any delay in shipping or delivery.
At the time of delivery, the customer is required to check the condition of the packaging and the conformity of the products ordered. In the event of apparent deterioration, it is recommended that the customer refuse to accept the package from the carrier. The customer must then notify the carrier and M de M of any reservations.
M de M cannot be held responsible for any delay in delivery due to the client’s unavailability after several proposed appointments with the carrier.
For orders placed in France and not delivered within thirty (30) days of confirmation of the order by M de M, the customer may cancel the order by registered letter with acknowledgement of receipt.
The customer will not be able to claim damages due to a delay in delivery.
In accordance with article L. 216-2 of the Consumer Code, the sale will then be considered as cancelled upon receipt of the registered letter, provided that the delivery has not taken place before the receipt of the letter. The customer may not in any case claim damages due to a delay in delivery.
10- Withdrawal – Return – Exchange of products
Only products that have been purchased directly on the M de M online sales site may be returned or exchanged. Products that have been customized at the request of the customer cannot be exchanged or refunded under any circumstances.
10.1 Return Policy
In the event that the customer is not satisfied with his/her order, for whatever reason, he/she has a maximum period of fourteen (14) days following receipt of his/her order to retract and return to M de M the product(s) ordered. After this period, the products will not be exchanged or refunded.
In the event that the withdrawal period expires on a Saturday, Sunday, public holiday or day off, it will automatically be extended to the next working day.
All products returned by the customer must be returned intact and in their original packaging.
To return the product(s) ordered, the customer must send an e-mail to eshop@manufacturedemonaco.com in order to receive the withdrawal form (to be attached to the parcel along with the invoice for the order) and a Colissimo pre-paid return label, which must be used, specifying whether it is a request for an exchange or refund. No return will be accepted without having followed this procedure.
M de M reserves the right to refuse to exchange or refund the returned product(s) in the event of apparent deterioration/depreciation of the product(s). Products that have been personalized at the request of the customer cannot be exchanged or refunded under any circumstances.

10.3 Return costs
? Case of a return from France
In accordance with article L. 221-23 of the French Consumer Code, M de M shall bear the cost of returns via the Colissimo prepaid return label provided to the Customer at his/her request, to the exclusion of any other method of shipping the products, the cost of which shall be borne by the Customer or the recipient of the Order.
? In the case of a return from Germany, Belgium, Luxembourg, the Netherlands, Austria, Spain, Ireland, Italy, Switzerland, Portugal, Denmark, Estonia, Hungary, Latvia, Lithuania, Poland, Czech Republic, Slovakia, Slovenia, Sweden, Switzerland and the United Kingdom
The costs of returning the goods shall be borne exclusively by the customer.
10.4 Refunds
In the event that the customer exercises his/her right of withdrawal, M de M will reimburse the sums paid (including delivery costs) by re-crediting the customer’s bank card used when placing the order within fourteen (14) days of receiving the returned products.
11- Personal data
The personal information provided by customers is used by M de M for the purpose of managing, executing and delivering orders only.
The processing of nominative information relating to customers has been declared to the CNIL under the number 2014534v0, in accordance with the “Informatique et Libertés” law no. 78-17 of 6 January 1978, modified by the law and no. 2004-801 of 6 August 2004.
Customers have the right to access, modify, rectify and delete data concerning them.
12- Product guarantees
The products on sale on the online shop benefit from the legal guarantee of conformity under the conditions provided for in Articles L. 217-4 to L. 217-13 of the Consumer Code as well as the guarantee against hidden defects as defined in Articles 1641 to 1649 of the Civil Code.
In the event of non-conforming or defective product(s), customers may return them in accordance with the conditions set out in Article 10, provided that they first contact Customer Services by email at eshop@manufacturedemonaco.com
Upon receipt of the returned products, M de M will send the customer replacement products provided that they are available. If necessary, M de M will refund the customer in full.
13- Force Majeure
The performance by M de M of all or part of its obligations will be suspended in the event of a fortuitous event or force majeure that hinders or delays its performance. Consequently, M de M cannot be held liable for failure to fulfil its contractual obligations.
The following are considered to be cases of force majeure or fortuitous events, without this list being restrictive: war, riots, insurrection, social unrest, disasters, fires, internal or external strikes, internal or external failures or breakdowns, and, in general, any external, unforeseeable and irresistible event that does not allow the proper execution of orders and deliveries.
14- Disputes
The contract between M de M and the client is governed by Monegasque law and the language of the proceedings is French. In the event of a dispute, the Court of First Instance of Monaco shall have sole jurisdiction.
